Terms of Service

• An order is one advertisement, in the format you choose (vertical, portrait, square or wide), in English or French, with a voice-over, music and, if you want them, subtitles. You send a brief with your photos or videos; nothing is paid at that stage.
• Three packages exist. Essential: an ad of 15 to 60 seconds edited from your photos and videos and checked by our team, with one round of changes. Plus: the same, where our engine may also create up to three scenes (a setting, a gesture, an atmosphere), never your product, with two rounds of changes. Signature, when it is offered: a film of 30 to 60 seconds in which our engine creates every scene, without ever passing off an invented picture as your product, with three rounds of changes. The price of each package is shown on the order page, and you pay the price shown on the day you send your brief.
• We aim to send a first preview within 24 hours of your brief. Times depend on the queue: this is an aim, not a guaranteed date.
• The preview carries a watermark, and you pay only after watching it: by card through our payment processor, or by an invoice we send you, at the package's regular price and payable within 14 days. As soon as the payment is received, the files of the approved version, without the watermark, unlock for download; they stay available in My orders, in the account your payment opens for you (we email you a sign-in link).
• A round of changes is a set of up to twelve changes you ask for together, which our team confirms before making them. Asking does not use a round. Any work beyond the rounds of your package is proposed to you before it starts.
• If you do not pay, nothing is owed: you receive no file without the watermark. You can ask us to stop at any time before you pay, by writing to hello@contact.x-celant.com: we stop the work, nothing is charged, and on request we delete your brief and its files. Once paid, an order is complete and is not canceled (see Refunds and Right of withdrawal).
• We may decline a brief we cannot make well or that breaks these Terms; nothing is charged for a declined brief. When free places are offered, a free place covers the Essential package and its files are delivered without payment.
• Your ad appears in our public gallery only if you accepted the gallery licence when ordering. You can withdraw that permission at any time by writing to us, and the ad then leaves the gallery within five working days.

• Refunds are made by us, on request, to the means of payment you used: write to hello@contact.x-celant.com. The site does not make them by itself.
• Plans: the period already started is not refunded when you cancel, except where the law requires it.
• Credit packs: credits have no cash value, and a pack is not refunded, except within the right of withdrawal (section 6) or where the law requires it.
• Made-for-you orders: you pay after watching the preview, so a paid order is not refunded, except where the law requires it. Before you pay, nothing is owed.
• When a payment is refunded or disputed, the credits it bought are taken back in proportion to the amount refunded; credits already used are not.
• Account deletion: deleting your account cancels an active subscription at once, with no refund of the period already started, and the credits left on the account are lost.

• If you are a consumer living in the European Union, you may withdraw from a contract made with us within 14 days, without giving a reason. The 14 days start on the day you buy a plan or a credit pack, or on the day you pay for a made-for-you order. To withdraw, use the button "Withdraw from the contract here" on the page x-celant.com/legal/withdraw, linked at the foot of every page: you confirm it on a second step and receive an acknowledgment with the date and time at once. You may also send us a clear statement before the 14 days end, for example by email to hello@contact.x-celant.com, or the model form below.
• Before you buy a plan, a credit pack, an add-on or a made-for-you order, a box you tick yourself asks you whether you want to use your purchase right away, or the files of the order delivered as soon as you pay, and to acknowledge what that means for this right. The payment does not open without it, and the invoice of your purchase repeats what you ticked.
• You lose this right: for a service, once it has been fully provided, when it started at your express request and you acknowledged that you would lose the right once it is fully provided; for digital content that is not supplied on a physical medium, once its supply has begun with your express prior consent and your acknowledgment that you thereby lose the right (Directive 2011/83/EU, article 16, points (a) and (m)). This is the case, for example, of a made-for-you ad whose files you received after paying, or of a production made with your credits at your request.
• When you withdraw in time, we refund what you paid within 14 days, to the means of payment you used. If you asked for a service to start within the 14 days, we may keep an amount in proportion to what was provided before you withdrew.
• Some countries outside the European Union give consumers similar rights; these Terms do not limit them.
• Model withdrawal form (fill it in and send it only if you wish to withdraw from the contract). You keep every right to the photos, videos and other material you send. You grant Meyandy LLC a limited, non-exclusive licence to host, process, transmit and display them only to run the service, including sending them to the processors described in our Privacy Policy, among them AI providers, to make what you ask for. You must have the rights needed for everything you send, including the permission of anyone recognisable in it.

What is made for you is yours to use: you may download the videos, posters, music and other results and use them for your business, in organic posts and in paid campaigns, with no time limit and without paying us anything more. We claim no right over them, except to show an ad in our gallery when you allowed it. Results made by AI models may resemble results made for others and may not be protected by copyright in every country: what these Terms give you is the right to use them, not a promise that nobody else can make something similar. One exception applies to what you create with trial credits before your first purchase: pictures and videos made that way carry the X-Celant watermark, and music made that way is for personal use only, never for your business or for advertising. What you create after your first purchase is yours for commercial use, without a watermark.
